KRISTIN Cavallari “is not scared of fighting” for full custody of her three children as she prepares to divorce husband Jay Cutler.
The pair announced on Sunday that they would be divorcing after 10 years together, and nearly seven years of marriage.
Kristin is mom to three children – sons Camden, 7, and Jaxon, 5, and daughter Saylor, 4 – and sources close to the reality star have now alleged that it was the children that forced the pair to deliberate for so long about the state of their relationship.
“They have had divorce talks back and forth for a while,” the source told People magazine.
“They didn’t want to get a divorce, because of the kids. Kristin has been very torn about it. When she realized that it just wasn’t possible for them to stay married, her focus was on keeping things amicable.”
However, the 33-year-old “wants full custody of the kids, because she feels she is able to provide the most stable environment for them”.
“Kristin is strong and confident. She is also an amazing mom. If Jay wants to break their deal about keeping things amicable, she is not scared of fighting for what she wants for their kids,” the insider added.
However, in papers exclusively obtained by The Sun, Jay claimed he has “always been the available at home parent and primary caretaker” of their children.
For this reason, he is asking for joint custody of their children.
Kristin denied Jay’s claims and said: “Wife would show that she has been the primary residential parent and that she is fit and proper person to be named Primary Residential Parent.”
Kristin further requested primary custody, with Jay receiving “reasonable periods of parenting time with said children”.
The pair confirmed their split in a joint statement shared on social media.
Kristin posted a photo of the duo walking away from the camera with their arms around each other.
The caption read: “With great sadness, after 10 years together we have come to a loving conclusion to get a divorce.
“We have nothing but love and respect for one another and are deeply grateful for the years shared, memories made, and the children we are so proud of. This is just the situation of two people growing apart. We ask everyone to respect our privacy as we navigate this difficult time within our family.”
Jay, 36, posted the same statement alongside a black and white picture taken during their relationship.
The split is sudden, as their last photo together was from March.
The Hills alum and the football star also recently returned from the Bahamas earlier this month after a three-week quarantine.
Jay was involved in a cheating scandal with Kristin’s best friend Kelly Henderson last year.
The court papers also reveal that Kristin is accusing her estranged husband Jay Cutler of “inappropriate marital conduct”.
She made the claims in a counterclaim in which she asked the court to dismiss his divorce complaint against her, writing: “Any misconduct alleged or implied against her in Complaint for Divorce was in response to and/or as a result of misconduct on behalf of husband.
Jay has denied the cheating claims.
